Mere Cohabitation and living for long years with a man will not give wife status

Mere cohabitation or negotiation for marriage is not a marriage. A document will not solemnize a marriage. Marriage in accordance with the custom of the community has to been conducted, unless it is proved there is no valid form of marriage. If the marriage is not took place in accordance with the manner known to law, then no one can claim husband and wife relationship.
Registered agreement entered into between parties agreeing that they would not take another spouse and that they accepted each other as husband and wife is not a marriage. Betrothal is not a marriage.
A person cannot be said to married merely they have a long and intimate relationship between them. The parties should show some valid forms of marriage well known to law. If there is no known manner of marriage format was performed then no one can assume a marriage was performed and the parties of such function can treat as husband and wife.
When a valid marriage is not established between the parties then the parties cannot claim husband and wife status. They wont be a legal heir of the other party and no share in the property can be claimed by the other party. Long and intimate relationship only shows the live-in relationship not declares the husband and wife status.
What are the valid format of marriages?
1.A Hindu and a Christian cannot undergo a marriage ceremony under Hindu Marriage format.
2.A Hindu and a Muslim cannot undergo a marriage ceremony under Muslim law.
3. Marriage between persons belong to different religion can undergo marriage only under special marriage format, if they perform marriage under any format then it is void.
4. A persons of Hindu or Christian cannot have a valid marriage by merely signing an agreement.
5.Having a reception without any marriage ceremony is not a valid marriage.
6. Having a marriage certificate without performing marriage ceremony is not a valid marriage.
7. Merely registering a fake marriage which was not held before the marriage register and obtaining marriage certificate is not a valid marriage.
8. Any marriage which took place without the recognized customary rites and practices between Hindus, Christians and Muslims or to any other religious persons is not a valid marriage.
9.Metinoning the name in Ration card or Aadhar card or Voter Id as husband and wife is not a valid proof of Marriage.
10. Birth certificates of the children is not a valid proof of Marriage.
11. Affidavit sworn before the Notary public and commissioner of oaths is not a valid marriage.
12. A man lived as husband and wife for more than 50 years presumption they are married.
13. No strict proof of marriage is necessary to claim maintenance under 125 Cr.P.C.
Accepted form of Hindu Marriage
1.Tying of mangalliyasootara or thali around the neck of the bride by the bridegroom was an essential rite to be performed so as to constitute a valid marriage between a man and a woman 
2. Taking seven steps by the men and women surround the sacred fire constitute a valid marriage.
3. In Tamilnadu marriage between any two Hindus, whether called suyamariyathai marriage or seerthiruththa marriage or by any other name, solemnized in the presence of relatives, friends or other persons-
(a) by each party to the marriage declaring in any language understood by the parties that each takes the other to be his wife or, as the case may be, her husband; or
(b) by each party to the marriage garlanding the other or putting a ring upon any finger of the other; or
(c) by the tying of the thali. The above things constitute a valid marriage.
4. Oral evidence of co-worker of wife and landlord, both parties living together as husband and wife which is sufficient proof of marriage for the purpose of maintenance under CR.P.C.  Supreme court in Kamala case in 2018(3) DMC 694.
5. Where a man and woman are proved to have lived together as man and wife along with his father and mother, the law will presume, unless the contrary be clearly proved, that they were living together in consequence of a valid marriage and not in a state of concubinage. 
6. The supreme court held in Tulsa case in 2008 (4) SCC 520 that under the light of the section 114 of the Evidence Act it is the Presumption of marriage that a man and woman living together for 30 years as man and wife is husband and wife
(a) Under Section 50 and 114 of Evidence Act marriage can be presumed from the common course of natural events and the conduct of parties as they are borne out by the facts of a particular case.
(b) The presumption was however, rebuttable, but a heavy burden lies on the person who contends that there was no marriage.

In the above light of the law it is necessary to register your marriage to avoid future complications.

Procedure for Christian Marriage in Chennai - 9962999008

The Indian Christian Marriage Act, 1872, says that all Christian marriages will be solemnized under its own provisions. In addition to that, by the virtue of Sec. 4, it states that, apart from Christian-Christian marriages, the marriage of a Christian with a non-Christian can also be solemnized under this Act.
The over-all conditions are same as for the other marriages, i.e. the marriage should take place with free consent of both the parties, bride and bridegroom should be of 18 and 21 years respectively, and neither party can have a spouse living.
Apart from this, following procedure is to be followed if marriage is performed under this Act:
  • Notice of intended marriage
If both, bride and groom, reside in the same area, either party will have to notify the Minister of Religion of their intention to marry by the way of a notice. If both the parties reside in different areas, each party has to make a separate notice in writing to the Marriage Registrar located within their areas of residence.
The notice has certain important details like-
  • If any of the party is minor: The father, if living, of the minor, or, if the father is dead, the guardian of the minor, and, in case there is no such guardian, then the mother of the minor, may give consent to the minor’s marriage, and such consent is hereby required for the same marriage, unless no person authorized to give such consent be resident in India.
  • The Minister then issues certificate in fulfilment of the notice to solemnize the marriage.
  • Persons authorized to solemnize: According to Sec. 5 of the Indian Christian Marriage Act, 1872, the following people are competent to solemnize a marriage. Marriages solemnized by any one other than these individual will stand void-
  1. A Clergyman of the Church of Scotland, as long as that such marriage be solemnized according to the rules, rites, customs and ceremonies of the Church of Scotland,
  2. A Minister of Religion licensed under this Act to solemnize marriages,
  3. In the presence of, a Marriage Registrar appointed under this Act or by him.
  4. A individual licensed under this Act to grant certificates of marriage between Indian Christians.
Performance of marriage
A Christian Marriage is performed between parties to the marriage according to the rituals that are regarded as proper and essential as per a Minister or Priest performing the marriage. The marriage rituals require presence of two witnesses apart from the minister or the priest performing the marriage.
If a marriage doesn’t gets performed within the period of two months after the issuance of the certificate of notice, such a marriage cannot be performed after the lapse of the two month period, and then a fresh certificate of notice has to be applied for in order to solemnize the marriage.
Marriage Registration
  • The Indian Christian Marriage Act, 1872, under Part IV deals with the marriage registration performed under this Act. The parties are required to make an application for the marriage registration to the concerned authority in whose Jurisdiction either of the party has been residing. The Marriage Register is where the Registrar, who is present and performs the marriage of the couple, registers the marriage.
  • An acknowledgement slip of the registration is signed by both the parties to the marriage along with their witnesses and this is attached to the register as a proof that the marriage was registered. These acknowledgement slips are sent out at the end of the month to the Registrar General of Births, Deaths and Marriages.
  • Indian Christian marriages may also be endorsed under a special provision without a prior notice.

According to the  Government, following documents are required to be submitted after being attested by a Gazetted Officer, for obtaining the registration of marriage as per Hindu culture:
  • An application form or a Memorandum of marriage duly signed by the husband and wife.
  • A documentary evidence for proof of date of birth of both the parties. This age, under both the Hindu Marriage Act and the Special Marriage Act, is 21 years for male and 18 years for the female. This document may be in the form of matriculation certificate/passport/birth certificate.
  • The residence proof of the husband and wife (Ration Card, Aadhar Card, Election Voter Id, PAN Card, or bills like Electricity Bill etc.)
  • Two passport size photographs of both the parties and one marriage photograph.
  • Marriage invitation card.

  • In case of marriage under the Hindu Marriage Act Rs. 100, and in case of marriage Special Marriage Act, Rs. 150, is needed to be submitted to the cashier of the district and the receipt is to be attached along with the application form.
  •  The parties are required to give an affirmation that they are not related and that they do not fall within the degree of prohibited relationship, as laid down under the Hindu Marriage Act 1955 and the Special Marriage Act, 1955.
  • An attested copy of the divorce decree/order in case of a divorcee and the death certificate of the spouse in case of widow/widower.
  •  If one of the parties belong to other than Hindu, Jain, Buddhist and Sikh religions, a conversion certificate from the priest who solemnized the marriage(in case of Hindu Marriage Act) will be required.
  • An affidavit by both the parties stating the place and the date of marriage, date of birth, marital status at the time of marriage and nationality.

Both must completed 18 & 21 years of age and any one should be a resident of registration office jurisdiction.
For solemnize special marriage , both bride and groom has to file notice intend of marriage in local jurisdiction marriage registrar office and the same will be affixed in registration office notice board for not less than 30 days.
If bride or groom is resident of outside jurisdiction, the copy of notice will be sent to your parents or your local registration office.
After 30 days from date of filing notice,the registrar will solemnize the marriage marriage if there is no objection received .
If there is any objection is received ,the marriage registrar will order enquiry and will pass final order accordingly.

Want to get your marriage registered? It’s not just your spouse’s consent that matters. Registration offices in Chennai and neighbouring districts are demanding consent letters from the groom’s parents. What is more weird, they don’t insist on such a document from the bride’s side, as a Chennai couple recently found out.
Sandya Raj* (25), of Chennai decided to get her marriage registered earlier this week. Sandya, parents, husband Rohan* (29) and his parents went to Thiruporur registration office with documents mandated under TN Registration of Marriages Act 2009.
Upon arrival, the officials asked her to produce a consent letter from the groom’s dad. “They also claimed my father-in-law’s letter had to be notarised, else the marriage would not be registered,” she said.
When Express did some fact checking, all officials unanimously agreed they seek such letters. One official in a registration office in Kancheepuram claimed she actually sought consent letters from parents on both sides to prevent “illegal” weddings.
The official said she started insisting on the letter ever since the “Supreme Court passed some order in this regard”. If the couple fails to produce the letter, she would hold an inquiry and talk to the parents. “It is up to the parents to stop the wedding. If they don’t get back, we do the registration.”
The official of Thiruporur town panchayat, who did not want to be identified, admitted he had asked for the letter and justified it, claiming he was acting on a “circular issued by the office of Inspector General of Registration a couple of months ago”.
But Inspector General of Registrations J Kumaragurubaran denied the existence of any such circular and said the last one sent by his office was on January 14, 2016.
“Registration officials cannot insist on parent’s consent. We will warn them if they force couples for it,” he said. He, however, added that the registrar has the right to refuse to register the marriage if he or she finds the documents suspicious.
Vaikunt Ramesh*, in his mid-twenties, and his girlfriend decided to get married last year, but did not want to inform their parents. The couple, along with their friends visited the registration office in Nungambakkam where they too were asked to produce the consent letter. However, he said he got around the problem by paying a few thousand rupees as bribe.
“We wanted to get done with the wedding without drawing too much attention. We were scared that they might go to the police, which is why we decided to pay the speed money,” he said alleging that the officials at the registration office deliberately make the procedure cumbersome till you are frustrated and don’t mind having a lighter wallet so as to celebrate the union in peace.
